A Continuing Student's Re-Entry Visa Was Denied
The headquarters of the IFCSS was contacted this morning by a
Chinese graduate student from Antwerpen, Belgium, and informed that
his application for re-entry F-1 student visa was denied at the U.S.
Embassy in Brussels. The student is currently studying at University
of Southern California. He came to the U.S. four years ago, and is
in the middle of his Ph.D study at USC. Several days ago, he, toge-
ther with his supervisor, traveled to Belgium to attend an interna-
tional conference co-sponosred by American Mathematicl Society and
University of Antwerp. When he applied re-entry F-1 visa for return-
ing to the US, his application was turned down. The consul felt not
satisfied and convinced at the appointment that he had a "solid tie"
in China which could prove he must go back to homeland when he com-
pletes his Ph.D study.
Working staffs at the HQ immediately called this student who is
stuck at a hotel in Belgium, and asked him to fax all travel docum-
ents available to the HQ. Then the HQ contacted the Visa Services
and China Desk of State Department, respectively, discussing the
case, providing student's detailed imformation and requesting for
clarification of the case and assistance for a favorable reconside-
ration. The International Student Office at USC was contacted, too.
Mr. Ted Allegra at State Dept. is currently reviewing the case, and
promises to send a cable to Brussels for the consul's reconsidera-
tion, and international advisor at USC will do the same. At this
moment we at the HQ are all keeing fingers crossed. Good luck, buddy!
The similar situation happened to several Chinese students years
ago. The IFCSS HQ would like to remind everyone who is going to tra-
vel in third country of consulting with ISSO carefully. Besides
valid visa application forms, school registration proof and finan-
cial support, some consul at the US Embassy may request "evidence"
that an applicant WILL and HAVE TO go back to homeland after gradua-
tion. The question sounds weird, but you must prove it, or you get
stuck somewhere. Then the question is how to prove that. IFCSS HQ
staff was educated by Mrs. Eleanor Harris at Visa Services on this
issue. Mrs. Harris interpreted that, some US consul insists on prov-
iding the proof that you are still affiliated to some "working unit"
in China and your former boss require you to be back; if your wife/
husband or kids are still in China, it could be a piece of proof,
too, but quite weak... Well, to prove or not to prove, it depends on
your fortune.
In IFCSS's letter to Mr. Allegra at State Departmentt, Mr. Xing
Zheng stated that, almost all university authorities encourage stud-
ents, including foreign students, to attend international academic
activities; International Advisors would not issue any I-20 forms
to these invited conference participants if foreign students' re-
entry could be jeopardized. The US consul's requirement is ambigous
and difficult to prove; makes foreign students extremely inconven-
ient at very awkward situation, may seriously interrupt the progress
of academic studies at American institutions and discourage foreign
students for academic exchange abroad.
IFCSS will contact other minority student groups to discuss this
issue and may initiate a formal compliant letter to the State Depart
-ment after this case is settled down.
